Commissioners deny permit due to possible legal issues

Due to possible future legal challenges stemming from a land covenant, Boone County Commissioners on Monday denied a conditional use permit for a hog finishing unit northwest of Albion requested by MSJM Farms.
In May, the proposed Class I 2,500-head swine unit had received a recommendation for approval from the Boone County Planning Commission. The recommendation included a condition that a covenant accompanying the property deed, signed by seller Marcia Seier and buyer Jerry Niewohner in 1999, accompany the application.
The covenant stipulated that no livestock confinement operation could be located on the land, which is along 240th Avenue between 220th and 230th Streets.
