Judge dismisses zoning violation cases

Boone County Court Judge Stephen Twiss directed a verdict dismissing all counts after a trial last Tuesday, April 26, on alleged zoning violations by the four principal owners of JSMM Farms, LLC.
County Attorney James Ely, prosecutor in the case, had alleged that Boone County zoning regulations were violated when the company started construction of a hog confinement northwest of Albion in October 2014 before obtaining a conditional use permit or construction permit.
In February of 2015, Ely had filed 64 Class III misdemeanor counts against each defendant, Jerry Niewohner, Steven Niewohner, Mark Niewohner and Matthew Niewohner.
