County Attorney James Ely, Jr. last Friday filed a response to a motion by defense attorney Jeff Jarecki to have Ely recused from County Court cases involving alleged zoning violations.
Eley listed five points in his reply, and said the misdemeanor charges against the four partners in JSMM Farms, LLC, because of evidence available in public information and testimony. A total of 64 misdemeanor counts were filed against each of four defendants for allegedly proceeding with construction of a hog confinement building before obtaining the required permits.
